The Constitutional Democracy in Kenya and Africa programme at Innovative Lawyering (IL) & Sihanya Mentoring (SM) focuses on research, training, publishing, practice, consulting and mentoring, as well as interdisciplinary public interest lawyering in Constitutional and governance questions, presidential election and practice, devolution resources governance, human rights and the rule of law in Kenya and Africa.

In summary, Constitutional Law and Democracy entails:
a. Presidential election, power, duties and privileges
b. Administrative system, bureaucracy and justice
c. Electoral process and law
d. Security and Criminal Justice
e. Public finance law
f. Devolution law
g. Human rights and the rule of law

Under this programme, IL & SM has consulted for a number of bodies and organisations. These include Government Ministries, the Judiciary, the National Cohesion and Integration Commission (NCIC), State Law Office (SLO), the Directorate of e-Strategy in the Office of the President, the Kenya National Commission on Human Rights (KNHCR);

Commission on Revenue Allocation (CRA) and Kenya Association of Manufacturers (KAM), the Commission on Administrative Justice (CAJ), Kenya National Office of the Auditor-General (KENAO), and the Committee of Eminent Persons (COEP) on constitutional review;

Statutory and civil society organisations like the Law Society of Kenya (LSK), the International Commission of Jurists (ICJ) Kenya; Kituo cha Sheria and Consumers Federation of Kenya (COFEK).

Remarkably, Prof Ben Sihanya teaches, supervises and mentors on Constitutional Law at the University of Nairobi Law School.

Ongoing Research in Constitutional Democracy in Kenya and Africa (CODEKA)

Under this programme, IL & SM is currently working on a book publication entitled “Constitutional Democracy in Kenya and Africa Volume 1 with book chapters on all the themes listed above.

Other areas of focus in the 2015 research agenda include presidential elections, administrative justice and constitutional implementation, enforcement as well as reform in Kenya.
